Terms and Conditions

1.1. SubhVivaah operates an online matrimonial and matchmaking platform intended to facilitate the discovery and communication of individuals seeking prospective matrimonial relationships.

1.2. SubhVivaah provides technology and related services that enable Users to create profiles, view profiles, communicate with other Users and otherwise interact with prospective matrimonial partners.

1.3. SubhVivaah is solely a facilitator of such introductions and communications and is not a party to any relationship, communication, understanding, agreement, transaction, engagement, marriage or other arrangement entered into between Users.

1.4. SubhVivaah does not guarantee that any particular number of profiles, matches, responses, communications, meetings or matrimonial opportunities will be available to any User during any subscription period.

2.1. Users shall provide information that is accurate, complete and not misleading and shall maintain the accuracy of such information throughout the period of their use of the Services.

2.2. A User shall not impersonate another person, misrepresent his or her identity, create an account on behalf of another person without appropriate authority, or knowingly provide false or misleading information.

2.3. You acknowledge that SubhVivaah may rely upon information supplied by Users and that SubhVivaah is not responsible for independently verifying the accuracy or completeness of such information unless expressly stated otherwise.

2.4. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities undertaken through your account. Accounts are created and accessed using a valid Google account; SubhVivaah does not independently issue or verify separate login credentials.

2.5. Where a User voluntarily discloses personal or other information directly to another User, whether through the Services or otherwise, such disclosure constitutes a User-to-User communication. SubhVivaah shall not be responsible for the subsequent use, disclosure, publication or misuse of such information by the receiving User, except to the extent required by applicable law.

3.1. By creating an account, you represent and warrant that:

(a) you are legally eligible to use the Services;

(b) you have attained the applicable legal age for marriage under the laws applicable to you, being at least twenty-one (21) years of age if you are male and at least eighteen (18) years of age if you are female, or such other age as may be prescribed by applicable law from time to time;

(d) you are legally competent to enter into a binding contract under the Indian Contract Act, 1872;

(e) your stated marital status (single, divorced, widowed, or otherwise) is true and accurate, and you are not currently a party to a subsisting, undissolved marriage except as truthfully disclosed on your profile;

(f) you are creating and using the account for your own matrimonial search, or, where permitted by the Services, on behalf of an immediate family member with that person's knowledge and consent.

3.2. SubhVivaah does not conduct police verification, background verification, income verification, employment verification, educational verification or any other independent verification of any User's identity or the accuracy of information supplied. Account creation requires only a valid Google account for sign-in; no government-issued identity document is verified by SubhVivaah at any stage. Users are solely responsible for independently verifying the identity, background, and representations of any other User before relying on such information or entering into any personal, matrimonial, financial or other arrangement with such User.

3.3. Where authentication is provided through Google or another third-party authentication provider, the User acknowledges that authentication is subject to the availability and applicable terms and policies of that third-party provider. SubhVivaah does not control the operation or security of such third-party authentication services.

4.1. Profiles, photographs, descriptions, statements, documents and other information submitted or displayed by Users ("User Content") are provided by the respective Users.

4.2. The publication or availability of a User profile on the Services shall not constitute or be construed as an endorsement, recommendation, representation or warranty by SubhVivaah concerning such User.

4.3. Without limiting the foregoing, SubhVivaah does not warrant or guarantee the identity, age, marital status, relationship status, education, employment, income, financial circumstances, family background, character, intentions, representations or conduct of any User.

4.4. Users acknowledge and agree that they are solely responsible for conducting such verification and due diligence as they consider necessary before relying upon information supplied by another User or entering into any personal, matrimonial, financial or other arrangement with such User.

5.1. Nothing contained in these Terms shall create or be deemed to create any partnership, joint venture, agency, fiduciary, employment or other representative relationship between SubhVivaah and any User. No User has authority to make any representation, warranty, commitment or undertaking on behalf of SubhVivaah.

5.2. All communications, interactions, meetings, relationships, arrangements and transactions between Users are undertaken solely between the relevant Users and at their own discretion and risk.

5.3. SubhVivaah shall have no responsibility or liability in respect of any representation, statement, omission, act or conduct of any User.

5.4. Users acknowledge that communications with other Users may be copied, recorded, screenshot, forwarded or otherwise reproduced by recipients, and SubhVivaah cannot guarantee the confidentiality of information voluntarily disclosed to another User.

5.5. Without limitation, SubhVivaah shall not be responsible or liable for any fraud, misrepresentation, deception, harassment, abuse, threats, financial solicitation, financial loss, emotional distress, personal injury, property damage, relationship dispute or other act or omission committed or allegedly committed by one User against another.

5.6. Nothing contained in these Terms shall be construed as a representation by SubhVivaah that any User is trustworthy, suitable, genuine, financially sound, legally eligible for marriage or otherwise fit to enter into a relationship with another User.

6.1. Users may, at their sole discretion, elect to communicate or interact with other Users through third-party platforms, applications or services, including telephone, email, messaging applications, social media platforms or in-person meetings.

6.2. Any communication, meeting, transaction, relationship or other activity undertaken outside the Services shall be outside the control and supervision of SubhVivaah.

6.3. For the avoidance of doubt, the fact that Users were introduced to one another, exchanged contact information, or commenced communication through the Services shall not render SubhVivaah responsible or liable for subsequent conduct occurring outside the Services.

6.4. SubhVivaah neither endorses nor authorises any off-platform activity undertaken by Users and shall not be deemed to have participated in, supervised, approved or guaranteed such activity merely because the parties were introduced through the Services.

6.5. To the maximum extent permitted by applicable law, SubhVivaah expressly disclaims any responsibility or liability arising from or relating to any off-platform communication, meeting, transaction, relationship, arrangement, representation, act or omission between Users.

6.6. A User's decision to disclose contact information, personal information, financial information, photographs, documents or any other information to another User, or to meet, transact or otherwise interact with another User outside the Services, shall be made solely at such User's own discretion and risk.

7.1. Users may report profiles, content or conduct that they reasonably believe to be fraudulent, abusive, threatening, harassing, unlawful or otherwise in violation of these Terms.

7.2. Upon receipt of a complaint, SubhVivaah may, at its discretion, conduct such review or investigation as it considers appropriate having regard to the circumstances and information available to it.

7.3. SubhVivaah may consider complaints, account information, communications, screenshots, documents and other evidence reasonably available to it in determining whether action should be taken.

7.4. Following such review, SubhVivaah may, without obligation to do so:

(a) issue a warning;

(b) restrict functionality;

(c) suspend an account;

(d) remove or disable a profile or User Content;

(e) terminate an account; or

(f) take such other action as SubhVivaah considers reasonably appropriate.

7.5. A User profile or account may be suspended or removed following review where SubhVivaah determines, in its reasonable discretion, that such action is warranted by the circumstances, including suspected violations of these Terms, applicable law or policies of the Services.

7.6. SubhVivaah does not undertake to investigate every complaint, guarantee any particular outcome from a complaint or disclose confidential information relating to an investigation or enforcement action.

7.7. Any action taken by SubhVivaah in relation to a User shall not constitute a judicial or legal determination concerning the truth, falsity, liability or criminal responsibility of any person.

7.8. SubhVivaah has no general obligation to monitor, investigate or independently verify all User Content, communications, profiles or activities conducted through the Services. Any monitoring, moderation, review or investigation undertaken by SubhVivaah shall be undertaken at its discretion and shall not create any continuing obligation to undertake similar monitoring, investigation or verification in the future.

Users shall not use the Services to:

(a) impersonate any person or entity;

(b) create fraudulent, deceptive or misleading profiles;

(c) knowingly provide false, inaccurate or misleading information;

(d) harass, threaten, intimidate, stalk or abuse another User;

(e) solicit money, loans, investments, financial assistance or other valuables through fraudulent or deceptive means;

(f) engage in fraud, unlawful solicitation or other unlawful activity;

(g) collect, disclose or misuse another User's personal information without lawful authority;

(h) distribute spam, unsolicited commercial communications or unauthorised advertisements;

(i) upload or transmit malicious code or other harmful material;

(j) attempt to obtain unauthorised access to accounts, systems or data;

(k) use automated means, bots, scraping technologies or similar mechanisms to access or collect information from the Services without prior written authorisation;

(l) infringe intellectual property, privacy or other legal rights of any person; or

(m) otherwise use the Services in violation of applicable law or these Terms.

9.1. All intellectual property rights in and to the Services, including the website, software, design, graphics, trademarks, logos, text, functionality and other materials provided by SubhVivaah, shall remain the property of SubhVivaah or its respective licensors.

9.2. Except as expressly permitted by these Terms or applicable law, no User shall reproduce, distribute, modify, publish, transmit, commercially exploit, reverse engineer or otherwise use any proprietary material belonging to SubhVivaah without prior written consent.

10.1. Users retain ownership of User Content submitted by them, subject to the rights and licences granted to SubhVivaah under these Terms and the Privacy Policy.

10.2. By submitting User Content to the Services, you grant SubhVivaah a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit and otherwise process such User Content to the extent reasonably necessary for the operation, provision, maintenance, security and improvement of the Services, subject to applicable law.

10.3. You represent and warrant that you have all rights and permissions necessary to submit such User Content and grant the foregoing licence.

11.1. SubhVivaah shall process personal data in accordance with its Privacy Policy and applicable law.

11.2. SubhVivaah will process personal data in accordance with applicable provisions of the Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, and other applicable data-protection laws, to the extent and from the dates such provisions apply to the Services.

11.3. All personal data collected through the Services is stored and processed within India. SubhVivaah does not transfer personal data outside India.

11.4. The categories of personal data collected by SubhVivaah, the purposes and legal basis for processing, applicable retention practices, disclosures, user rights (including access, correction and erasure) and other privacy matters are set out in the Privacy Policy.

11.5. By using the Services, you acknowledge that you have had an opportunity to review the Privacy Policy.

12.1. The Services may contain links to, integrations with or functionality provided by third-party websites, applications, payment providers or other services, including Google account sign-in.

12.2. SubhVivaah does not control or assume responsibility for the availability, content, security, privacy practices or conduct of any third-party service.

12.3. Your use of any third-party service shall be governed by the applicable terms and policies of that third party.

13.1. Certain features of the Services (including enhanced profile visibility, unlocking contact details, or premium messaging) are offered on a paid subscription basis ("Paid Services"). Applicable fees and billing cycles will be displayed at the point of purchase.

13.2. Subscriptions do not auto-renew. A subscription lapses at the end of its paid term and access to the corresponding Paid Services will cease unless the User manually repurchases a subscription.

13.3. Except as required by applicable law or as expressly stated at the point of sale, fees paid for Paid Services are non-refundable once the corresponding feature has been activated or delivered.

13.4. Where an account is suspended or terminated for a breach of these Terms, no refund shall be due for the unexpired portion of any subscription.

13.5. Nothing in this Section limits a User's rights under the Consumer Protection (E-Commerce) Rules, 2020 or the Consumer Protection Act, 2019.

14.1. To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

14.2. SubhVivaah makes no representation or warranty, express or implied, concerning:

(a) the accuracy, completeness or reliability of User Content;

(b) the identity or authenticity of any User;

(c) the conduct, intentions or representations of any User;

(d) the suitability of any prospective matrimonial partner;

(e) the uninterrupted availability or error-free operation of the Services; or

(f) the likelihood of any particular matrimonial or relationship outcome.

14.3. Users acknowledge that SubhVivaah cannot guarantee the conduct or representations of persons using an online matchmaking platform and that interactions with other Users involve inherent risks.

15.1. To the maximum extent permitted by applicable law, SubhVivaah, its owner, employees, agents, contractors, service providers and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive loss or damage arising out of or in connection with the Services or these Terms.

15.2. Without limiting Clause 15.1, SubhVivaah shall not, to the maximum extent permitted by applicable law, be liable for any loss, damage, injury, expense, claim or liability arising out of or relating to:

(a) the conduct, acts or omissions of any User;

(b) any representation or information supplied by a User;

(c) any communication or interaction between Users;

(d) any relationship, arrangement, engagement or marriage between Users;

(e) any transaction between Users;

(f) any meeting between Users;

(g) any fraud, deception, harassment, abuse or unlawful conduct by any User;

(h) any communication, meeting, transaction or other activity occurring outside the Services; or

(i) any reliance placed by a User upon information supplied by another User.

15.3. Where SubhVivaah is found liable to a User for any direct loss or damage notwithstanding the foregoing, such liability shall, to the maximum extent permitted by applicable law, not exceed the total subscription fees paid by that User to SubhVivaah in the twelve (12) months preceding the event giving rise to the claim.

15.4. Users expressly acknowledge that SubhVivaah provides a platform for introductions and communications and does not assume responsibility for the independent actions or decisions of Users.

15.5. Nothing in these Terms shall exclude or limit any liability to the extent that such liability cannot lawfully be excluded or limited under applicable law.

15.6. To the extent any limitation, exclusion or restriction contained in these Terms is determined to be unenforceable under applicable law, such provision shall be interpreted and enforced to the maximum extent legally permissible.

Nothing in these Terms, including the governing law, jurisdiction, or limitation of liability clauses, shall be construed as limiting or waiving any right a User may have to approach a Consumer Commission or other statutory forum under the Consumer Protection Act, 2019, or any other applicable law that permits filing at the User's own place of residence or work.

17.1. To the maximum extent permitted by applicable law, you agree to indemnify, defend and hold harmless SubhVivaah and its owner, employees, agents, contractors, service providers and representatives from and against any claims, demands, actions, proceedings, liabilities, losses, damages, costs and expenses, including reasonable legal expenses, arising out of or relating to:

(a) your breach of these Terms;

(b) your User Content;

(c) your violation of applicable law or the rights of another person;

(d) your misuse of the Services; or

(e) your acts, omissions or interactions with another User.

18.1. SubhVivaah reserves the right to suspend, restrict or terminate a User's access to the Services where it reasonably believes that the User has breached these Terms, violated applicable law, engaged in fraudulent or abusive conduct, or otherwise created a risk to the Services, SubhVivaah or other Users.

18.2. SubhVivaah may also suspend or terminate access where reasonably necessary for security, technical, operational or legal reasons.

18.3. Termination or suspension shall be without prejudice to any rights or remedies that accrued prior to such termination or suspension.

SubhVivaah reserves the right to modify, suspend, discontinue or restrict any portion of the Services at any time where reasonably necessary, including for technical, operational, security, commercial or legal reasons.

SubhVivaah shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including acts of God, natural disasters, epidemic or pandemic events, war, civil unrest, governmental action, telecommunications failure, internet disruption, cyber incidents, power failure, infrastructure failure, third-party service outages or other events beyond SubhVivaah's reasonable control

21.1. These Terms shall be governed by and construed in accordance with the laws of India.

21.2. Subject to Clause 16 (Consumer Rights Preserved) above, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

22.1. 22.2. Complaints will be acknowledged within twenty-four (24) hours of receipt and resolved within fifteen (15) days of receipt, save where a shorter timeline is mandated by applicable law for specific categories of complaint.

22.3. Where applicable law requires the appointment of a Data Protection Officer or other designated person, the relevant contact details shall be published through the appropriate section of the Services.

23.1. SubhVivaah reserves the right to amend these Terms from time to time to reflect changes to the Services, applicable law, regulatory requirements or business practices.

23.2. Where required by applicable law, reasonable notice of material amendments shall be provided.

23.3. Your continued use of the Services following the effective date of amended Terms shall constitute acceptance of the amended Terms to the extent permitted by applicable law.

If any provision of these Terms is held to be unlawful, invalid or unenforceable, such provision shall, to the extent possible, be modified or enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

No failure or delay by SubhVivaah in exercising any right or remedy under these Terms shall constitute a waiver of such right or remedy.

These Terms, together with the Privacy Policy and any other policies expressly incorporated herein, constitute the entire agreement between you and SubhVivaah concerning your use of the Services and supersede prior understandings relating to the same subject matter, except to the extent additional terms expressly apply to particular Services.
